Cancelled Checks and Bank Statements

Cancelled checks issued by the Sheriff in payment for supplies and groceries purchased for use at the jail, name of payee, amount, purpose of payment, name of bank on which drawn, signature of Sheriff. 7-6-6, -7 (obsolete)

Retain ten (10) years, then destroy. (Refer to County Clerk schedule)    
Delinquent Property Taxes

List of all real property returned delinquent after taxes have been unpaid for a period of one year. Prepared by the Sheriff and submitted to County Court. Shows name of owner, location, description and assessed value of property, total amount of tax and period for which due, date redeemed or sold. 11A-2-11

Three (3) years, then destroy. Sheriff created in May. Filed with County Clerk in June. 11A-2-14 Permanent

Fee Record Books

Sheriff's records of all fees collected. 59-1-29, 59-1-30

Retain five (5) years or until Tax Commissioner audit and exceptions cleared, then destroy.    
Forfeited and Delinquent Land Records

A. Receipts from Deputy Land Commissioner for sales and redemption.

B. Record of Forfeited and Delinquent Land by suits filed in Circuit Court. Permanent Land Book

List of real estate owners showing names of owners, location, description, acreage of property, assessed value and allocation of tax to various county funds. 11-4-1

Ten (10) years. Offer to county clerk, destroy if refused.    
Personal Property Books

List of personal property prepared by assessor for tax assessment purposes. Shows name of property owner, description and assessed value of property with allocation of tax to various state, county, district and municipal funds. 11-3-19

Five (5) years after settlement, then destroy.    
Taxation and Finance        
Sheriff's Delinquent Sales

List of real estate returned delinquent for nonpayment of taxes, giving name of property owner, address, location, description and acreage of land, amount of tax due, date returned delinquent, amount of redemption and name of redemptioner; if sold, date and amount of sale, name of purchaser. 11A-3-36 , 11A-3-38

Sheriff's Monthly Financial Statement

Monthly report showing status of all county accounts.

Retain five (5) years and until Tax Commissioner audit and exceptions cleared, then destroy.Consolidated into annual report - is monthly needed?
Sheriff's Official Receipt Book

Receipts for all money received except taxes. 59-1-30

Two (2) years after Tax Commissioner audit, then destroy.    
Sheriff's Orders and Checks

Orders and checks paid by banks and retained by Sheriff for various funds within county.

Retain five (5) years and until Tax Commissioner audit and exceptions cleared, then destroy.    
Sheriff's Record of Receipts and Disbursements

A. Record of all receipts posted from receipt book

B. Record of all checks issued (orders issued) from various funds by "County Commission"

C. Distribution to proper funds of all taxes collected. 11A-1-13, 59-1-24, 59-1-25

Record kept in book form of all taxes collected in the county. 6-8-5

Sheriff's Settlement Book

Original annual settlements made by Sheriff and submitted to County Court for approval. 6-8-5 - 12

Filed with County Clerk as permanent record.    
Suggestee Executions

Record of receipts and disbursements for collection of Suggestee Executions, etc.

Retain five (5) years and until Tax Commissioner audit and exceptions cleared, then destroy.    
Tax Tickets

Tax tickets showing number, name of taxpayer, address, amount due, total plus interest or less discount, total amount collected, and date. 11A-1-12

Two (2) years after Tax Commissioners audit, then destroy.

Retain until two (2) years after payment or sale of property and Tax Commissioners audit, then destroy.

   
Law Enforcement        
Accident Reports

Motor vehicle accidents reports giving location of accident, persons and vehicles involved, time of accident, injured, witnesses, diagram of accident and condition of persons involved. 17C-4-8, -9

Three (3) years, then destroy.    
Activities Reports

Deputies reports of their activities. May be daily, weekly or monthly.

Retain one (1) year, then destroy.    
Appeals to Supreme Court of Appeals

Cases appealed from lower courts to Supreme Court of Appeals, stating names of parties to suit, style of case, action taken by lower courts with dates, action taken by Supreme Court of Appeals and costs. 58-5- 6

Retain until of no further value, then destroy.    
Commitment Records

Arrest record of person committed to jail filled out for each person who is arrested. 62-1-19

Retain five (5) years, then destroy.    
Complaint Calls

Record of all calls for complaints of some matter reported to the Sheriff's Office.

Retain one (1) year, then destroy.    
County Payroll Sheets

Record of all employees of the Sheriff's Department showing all aspects of payroll. Shows amount paid and amount taken out for taxes.

Retain until records lose administrative value, then destroy.    
Finger Print Records

Finger prints of all charged or arrested persons committed to jail or on bail. 15-2-24

Retain as long as they have value, then destroy.    
Jail Records

Report submitted to the County Judge on the amount due for boarding prisoners, showing name of Sheriff, month for which board is due, name of prisoner, offense charged, number of days boarded, rate per day. 7-8- 2A

Retain five (5) years and until Tax Commissioner audit and exceptions cleared, then destroy.    
Jury Order Transmittals

Orders issued by Circuit Clerk and payable by Sheriff for jury service. Shows name of jurors, case served, date, mileage, days in attendance, amount paid, date and number of order. These payments are reimbursed from State Treasury.

Retain until Tax Commissioner audit and exceptions cleared, then destroy.    
Justice of the Peace Civil Dockets

Record of all civil cases heard in justice's court. Shows appointment of special constables, pleadings, title of all actions in suit, names of parties to suit, date of action, amount involved, date of summons and return. Name of agent complaint, continuance, if any, verdict of jury, judgment satisfaction and other action. 50-16-1-11 (obsolete)

       
Prisoners Report

Record of all prisoners committed to the county jail, showing name of prisoner, offense charged, by whom charge brought, record of process, date of commitment, amount of fine and costs, number of days served in lieu of fine payment, and date released, also age, sex, color of hair, color of eyes and complexion. 7-8-2A (obsolete)

Ten (10) years or until audit, whichever is later, then destroy.    
Radio Logs

Record of radio calls giving time called, car or station calling, car or station called, car location, nature of call, and acknowledgment. 15-3-3

Two (2) years, then destroy.    
Sheriff's Invoices

Invoices for boarding prisoners, for supplies and groceries for use in jail and general expenses. 7-8-2A (obsolete)

Retain two (2) years after Tax Commissioner audit, then destroy.    
Visitor's Log

Log of all persons who visit prisoners contains name of person, date. 50-18-4 (obsolete)

Two (2) years, then destroy.
